The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 23, 2024 SPR24/1461 Lisa Jane Hardin Town Clerk Town of Millis 900 Main Street, Room 124 Millis, MA 02054 Dear Ms. Hardin: I have received the petition of Gerard Burke appealing the nonresponse of the Town of Millis (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 29, 2024, Mr. Burke requested “...copies of all written authorization of the Police Chief exempting construction at Regency at Glen Ellen before 7AM and after 6PM and the showing of good cause from July 15th, 2023 until April 29th, 2024 granted in relation to all construction activity at the Regency at Glen Ellen, provided to Toll Brothers or directly to each of their contractors and subcontractors and addressing exemptions to any and all construction, and excavation activity.” Claiming to not yet have received responsive records, Mr. Burke petitioned this office and this appeal, SPR24/1461, was opened as a result. Subsequently, I learned that the Town provided Mr. Burke with a response dated May 14, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Burke may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
