Records Access Officer/Interim General Counsel Massachusetts Development Finance Agency 99 High Street Boston, MA 02110 Dear Attorney Calnan: I have received the petition of Colman Herman appealing the response of the Massachusetts Development Finance Agency (Agency) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 4, 2024, Mr. Herman requested, “any and all internal and external communications related to [a named individual] for the period January 1, 2024 to the present.” The Agency responded on May 17, 2024. Unsatisfied with the response, Mr. Herman petitioned this office and this appeal, SPR24/1534, was opened as a result. Subsequently, I learned that the Agency provided Mr. Herman with a further response dated June 3, 2024. Where this appeal was opened as a result of the Agency’s May 17th response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Agency’s June 3rd response within ninety (90) days. See 950 C.M.R. 32.08(1).
