Desiderio Records Access Officer City of Malden 215 Pleasant Street Malden, MA 02148 Dear Ms. Desiderio: I have received the petition of Commonwealth Transparency (“requestor”) appealing the response of the City of Malden (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 7, 2024, the requestor sought “documents/records in the possession or under the control of your school/district or town/city for the time period January 1, 2018 through April 5, 2024: [1] Any and all electronic calendars of [a named individual] including draft and deleted items. [2] Any and all electronic calendars of [a named individual], including draft and deleted items, including draft and deleted items which includes the following words/cities/school districts: Arlington [Massachusetts], Bedford [Massachusetts], Georgetown [Massachusetts], Middleton [Massachusetts], Salem [Massachusetts], Ipswich [Massachusetts], Winchendon [Massachusetts][.] On April 15, 2024, the requestor modified his request to include the timeframe “January 1, 2018 through April 15, 2024.” Previous Appeals This request was the subject of previous appeals. See SPR24/1110 Determination of the Supervisor of Records (April 19, 2024) and SPR24/1323 Determination of the Supervisor of Records (May 14, 2024). In my May 14th determination, I closed SPR/1323 in light of the City’s intent to provide a supplemental response. Subsequently, the City responded on May 20, 2024. Unsatisfied with the response, the requestor petitioned to this office, and this appeal, SPR24/1545, was opened as a result. Where this appeal was opened as a result of the City’s May 20, 2024 response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the City’s May 29th response within ninety (90) days. See 950 C.M.R. 32.08(1).
