Gaitan Records Access Officer Massachusetts National Guard Office of the Staff Judge Advocate 50 Maple Street Milford, MA 01757-3604 Dear Mr. Gaitan: I have received the petition of Andrew Gottlieb appealing the nonresponse of the Massachusetts National Guard (Guard) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 7, 2024, Mr. Gottlieb requested “[a]ny and all documents, including, but not limited to, e-mails, letters, memorandums of understanding, requests for proposals or contracts from January 1, 2023 to the present day relating to draft or final construction contracts associated with the construction of the proposed Multipurpose Machine Gun Range on Joint Base Cape Cod.” Claiming to not yet have received responsive records, Mr. Gottlieb petitioned this office and this appeal, SPR24/1560, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Guard has provided a response. Accordingly, the Guard is ordered to provide Mr. Gottlieb with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Gottlieb may appeal the substantive nature of the Guard’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
