Scanlan Primary Records Access Officer Executive Office of Health and Human Services One Ashburton Place Boston, MA 02108 Dear Ms. Scanlan: I have received the petition of Andrew M. London, Esq., of Foley Hoag LLP, appealing the response of the Executive Office of Health and Human Services (Office) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On April 1, 2024, Attorney London requested, the following records: [1] All email correspondence from April 1, 2023 to present between [an identified individual] and any of the following [identified] MassHealth employees[;] [2] All email correspondence from May 17, 2022 to May 17, 2023 between employees, officers, or agents of Dental Benefit Management, Inc. d/b/a Benecare Dental Plans and any of the following [identified] MassHealth Employees[;] [3] All email correspondence from April 1, 2023 to present regarding [an identified individual] between any of the following [identified] MassHealth employees[.] On April 16, 2024 and May 2, 2024, the Office provided responses. Unsatisfied with the Office’s responses, Attorney London petitioned this office and this appeal, SPR24/1576, was opened as a result. Subsequently, I learned that the Office provided a further response to Attorney London on June 4, 2024. Where this appeal was opened as a result of the Office’s April 16, 2024 and May 2, 2024 responses, I will now consider this administrative appeal closed. Attorney London may appeal the substantive nature of the Office’s June 4th response within ninety (90) days. See 950 C.M.R. 32.08(1).
