The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 5, 2024 SPR24/1578 Angela Jack Town Clerk Town of Ashby Ashby Town Hall 895 Main Street Ashby, MA 01431 Dear Ms. Jack: I have received the petition of Patrick McPhee appealing the nonresponse of the Town of Ashby (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 25, 2024, Mr. McPhee requested “the budget Excel sheet that is used by the town.” Claiming to not yet have received responsive records, Mr. McPhee petitioned this office and this appeal, SPR24/1578, was opened as a result. Subsequently, I learned that the Town provided Mr. McPhee with a response dated May 30, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. McPhee may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
