The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 3, 2024 SPR24/1590 Carol Desiderio City Clerk City of Malden 215 Pleasant Street Second Floor, Room 220 Malden, MA 02148 Dear Ms. Desiderio: I have received the petition of Commonwealth Transparency (“requestor”) appealing the response of the City of Malden (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 9, 2024, the requestor sought, “…any communications regarding, including or otherwise referencing the attached email from OpenCommonwealth.org originally sent Monday April 15, 2024 at 10:02:39 AM. This request specifically seeks but is not limited to any forwarding of the attached email, and any routing of this email and any responses.” The City provided a response on May 24, 2024. Unsatisfied with the City’s response, the requestor petitioned this office and this appeal, SPR24/1590, was opened as a result. Subsequently, I learned that the City provided the requestor with a response on June 3, 2024. Where this appeal was opened as a result of the City’s May 24th response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the City’s June 3rd response within ninety (90) days. See 950 C.M.R. 32.08(1).
