See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 16, 2024, Mr. Hopkins requested “all records [the] office has on [a named individual] who has an extensive history of public lewdness and indecent exposure around the community dating back numerous years.” On the same day, Mr. Hopkins modified his request to “limit ‘all records’ to just ‘all police reports.’” The Office responded on May 23, 2024, denying the request, and claiming that the responsive records are exempt from disclosure under the Criminal Offender Record Information (CORI) Act, as it operates through Exemption (a) of the Public Records Law. See G. L. c. 4, § 7(26). Unsatisfied with the Office’s response, Mr. Hopkins appealed, and this case was opened as a result. Subsequent to the opening of this appeal, based on a telephone conversation between this office and an attorney for the Office on June 10, 2024, I understand that the Office intends to provide a supplemental response to Mr. Hopkins. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Hopkins may appeal the substantive nature of the Office’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
