The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 11, 2024 SPR24/1608 Brenda Perez Police Sergeant Brockton Police Department 7 Commercial Street Brockton, MA 02302 Dear Sergeant Perez: I have received the petition of Jonas Fransique appealing the nonresponse of the Brockton Police Department to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 15, 2024, Mr. Fransique requested an identified case file for a May 7, 2004 incident. Claiming to not yet have received responsive records, Mr. Fransique petitioned this office and this appeal, SPR24/1608, was opened as a result. Subsequently, I learned that the Department provided Mr. Fransique with a response on May 31, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Fransique may appeal the substantive nature of the Department’s May 31st response within ninety (90) days. See 950 C.M.R. 32.08(1).
