The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 11, 2024 SPR24/1624 David O’Sullivan, Esq. Records Access Officer Essex County District Attorney’s Office 10 Federal Street Salem, MA 01970 Dear Attorney O’Sullivan: I have received the petition of Andrew Quemere, appealing the nonresponse of the Essex County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 13, 2024, Mr. Quemere requested: [1.] All records showing the start and end dates of the employment of [an identified individual], a former assistant district attorney who worked at the Essex County District Attorney’s Office until approximately 1982 or 1983[;] [2.] All employee evaluations of [an identified individual;] [3.] All resignation letters by [an identified individual;] [4.] All termination letters related to [an identified individual;] [5.] All records related to complaints and investigations of alleged misconduct by [an identified individual.] Claiming to not yet have received responsive records, Mr. Quemere petitioned this office and this appeal, SPR24/1624, was opened as a result. Subsequently, I learned that the Office provided Mr. Quemere with a response on May 30, 2024. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. Quemere may appeal the substantive nature of the Office’s response within ninety (90) days.
