The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 11, 2024 SPR24/1627 Helene Bettencourt Records Access Officer Department of Elementary and Secondary Education 135 Santilli Highway Everett, MA 02149 Dear Ms. Bettencourt: I have received the petition of Daphne Corder appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 21, 2024, Ms. Corder requested the below records “[f]or the following years: 2021,2022 [sic], 2023 and up to May 1, 2024[:]” [1.] Number of Special education mediation requests made by a person or agency representing a child in foster care (under conservatorship of the state of MASS.)[;] [2.] Number of Due process complaints filed by a person or agency representing a child in foster care (under conservatorship of the state of MASS)[;] [3.] Number of special education complaints made to Mass. Dept of Education regarding a child in foster care (under conservatorship of State of Mass.)[.] The Department provided a response on May 30, 2024. Unsatisfied with the Department’s response, Ms. Corder petitioned this office and this case was opened as a result. Subsequent to the opening of this appeal, I learned that the Department provided a supplemental response by email to Ms. Corder and this office on June 10, 2024. As this appeal was opened based on the Department’s May 30, 2024 response, I will now consider this administrative appeal closed. If unresolved issues remain, Ms. Corder may appeal the substantive nature of the School’s June 10th response within ninety (90) days. See 950 C.M.R. 32.08(1).
