Whitaker Records Access Officer Town of Dalton 462 Main Street Dalton, MA 01226 Dear Ms. Whitaker: I have received the petition of Mark Hourihan, of Live Boston News, appealing the nonresponse of the Dalton Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 13, 2024, Mr. Hourihan requested “…the police report, booking photo and Body/Cruiser footage from the incidents related to the pursuit of [an identified individual] in March of 2023…” Claiming to not yet have received responsive records, Mr. Hourihan petitioned this office and this appeal, SPR24/1650, was opened as a result. Subsequently, I learned that the Department provided Mr. Hourihan with a response dated May 1, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Hourihan may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
