See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 13, 2024, Mr. Herman requested, “…copies of the most recent versions of the City of Newton’s collective bargaining agreements with the Newton Police Association and with the Newton Police Superior Officers Association….” The City responded on May 20, 2024. Unsatisfied with the City’s response, Mr. Herman petitioned this office and this appeal, SPR24/1655, was opened as a result. Subsequently, on June 7, 2024, the City provided a supplemental response to Mr. Herman, including additional responsive documents. On June 8, 2024, Mr. Herman furthered appealed this supplemental response. Subsequently, I learned that the City intends on providing a further response to Mr. Herman. Accordingly, the City is ordered to provide Mr. Herman with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
