The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 11, 2024 SPR24/1655 Greta McConnell Public Records Administrator City of Newton 1000 Commonwealth Avenue Newton Centre, MA 02459 Dear Ms. McConnell: I have received the petition of Colman Herman appealing the response of the City of Newton (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 13, 2024, Mr. Herman requested, “…copies of the most recent versions of the City of Newton’s collective bargaining agreements with the Newton Police Association and with the Newton Police Superior Officers Association….” The City responded on May 20, 2024. Unsatisfied with the City’s response, Mr. Herman petitioned this office and this appeal, SPR24/1655, was opened as a result. Subsequently, on June 7, 2024, the City provided a supplemental response to Mr. Herman, including additional responsive documents. On June 8, 2024, Mr. Herman furthered appealed this supplemental response. Subsequently, I learned that the City intends on providing a further response to Mr. Herman. Accordingly, the City is ordered to provide Mr. Herman with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
