Associate City Solicitor City of New Bedford 133 William Street New Bedford, MA 02740 Dear Attorney Schuko: I have received the petition of Colin Hogan, of the New Bedford Light, appealing the response of the City of New Bedford (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 15, 2024, Mr. Hogan requested, “... documents relating to internal investigations of staff at Roosevelt Middle School from June 1, 2023 through present.” Prior Petition The requested records were the subject of a prior petition. See SPR24/1631 Determination of the Supervisor of Records (June 6, 2024). In my June 6th determination, I found that to the extent the responsive records contain the exempt information as described, the City may assess a fee for segregation and redaction. I also found that the City had not met its burden to explain how the request could not prudently be completed without assessing a fee in excess of $25.00. The City responded on May 30, 2024 and June 11, 2024. Unsatisfied with the City’s responses, Mr. Hogan petitioned this office and this appeal, SPR24/1748, was opened as a result. Subsequently, I learned that the City provided an additional response to Mr. Hogan later on June 11, 2024. Where this appeal was opened as a result of the City’s May 30, 2024 and initial June 11, 2024 responses, I will now consider this administrative appeal closed. Mr. Hogan may appeal the substantive nature of the City’s subsequent June 11th response within ninety (90) days. See 950 C.M.R. 32.08(1).
