Assistant Attorney General Records Access Officer Office of the Attorney General One Ashburton Place, 20th Floor Boston, MA 02108 Dear Attorney Rush: I have received the petition of Mitch Ruscitti appealing the response of the Office of the Attorney General (AGO) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 29, 2024, Mr. Ruscitti requested the following records: [1] ... any documentation and communications received by this office regarding the Complete Streets Project in Hopedale, MA on Adin Street; specifically, any communications and records pertaining to Adin Street in Hopedale, MA and/or the Complete Streets Grant awarded to Hopedale, MA; [2] any records, documents, or communications from [identified individuals] regarding Adin Street, Complete Streets, or Hopedale. I would further request any documents or communications sent from the Office of Inspector General to anyone at the AGO’s office regarding Adin Street in Hopedale, MA or the Complete Streets Grant in Hopedale. [3] ... any communications regarding Complete Streets and/or Adin street to and from [identified individuals]. Prior Appeal The requested records were the subject of a prior appeal. See SPR24/1444 Determination of the Supervisor of Records (May 23, 2024). In my May 23rd determination, I learned that the AGO provided Mr. Ruscitti with a supplemental response dated May 20, 2024. Subsequently, the AGO provided an additional response on May 28, 2024. Unsatisfied with the responses, Mr. Ruscitti petitioned this office and this appeal, SPR24/1753, was opened as a result. Accordingly, the AGO is to provide Mr. Ruscitti with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Ruscitti may appeal the substantive nature of the AGO’s response within ninety days.
