Roomey Records Access Officer City of Salem – Legal Department 143 Fort Avenue Salem, MA 01970 Dear Ms. Roomey: I have received the petition of Philip Laffy appealing the response of the City of Salem (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 25, 2024, Mr. Laffy requested the following records related to the City’s parking program: [1.] A full accounting (every line item) of the current program costs, and revenues[;] [2.] The proposed costs of the new program detailing each line item and the projected revenues and how the proposed revenues are calculated. [3.] The average parking meter produces in revenue (payments and violations revenue) both per annum and for the months from May 1 through October 31. Previous Appeals These requests were the subject of previous appeals. See SPR24/1692 Determination of the Supervisor of Records (June 17, 2024) and SPR24/1693 Determination of the Supervisor of Records (June 17, 2024). In my June 17th determinations, I closed SPR24/1692 and SPR24/1693 in light of the City providing a written response to Mr. Laffy on June 17, 2024. Unsatisfied with the City’s response, Mr. Laffy petitioned this office, and this appeal, SPR24/1793, was opened as a result. Subsequent to the opening of this appeal, based on an email from the City to this office and Mr. Laffy on June 28, 2024, I understand that the City intends to provide a supplemental response to Mr. Laffy. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Laffy may appeal the substantive nature of the City’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
