Assistant General Counsel Board of Registration in Medicine 178 Albion Street, Suite 330 Wakefield, MA 01880 Dear Attorney Douglas: I have received the petition of Colman Herman appealing the response of the Board of Registration in Medicine (Board) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 4, 2024, Mr. Herman requested the following: [C]opies of any and all disciplinary records that deal with sexual misconduct, sexual harassment, boundary violations, boundary crossings, and/or like involving physicians. I am seeking records that reveal the details of the incidents and the dispositions of the cases. This is for the period January 1, 2020 to the present. On May 9, 2024, Mr. Herman clarified that he seeks only “disciplinary actions” for “just sexual ... boundary records.” In numerous correspondences from May 20, 2024 through June 18, 2024, the Board indicated it would require additional time to provide the responsive records. Unsatisfied with the Board’s responses, Mr. Herman petitioned this office, and this appeal, SPR24/1816, was opened as a result. Subsequent to the opening of this appeal, I learned that the Board provided supplemental responses by email to Mr. Herman and this office on June 24 and June 25, 2024. As this appeal was opened based on the Board’s previous responses, I will now consider this administrative appeal closed.
