The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 3, 2024 SPR24/1822 Lieutenant Robert Avery Records Access Officer Lynn Police Department 300 Washington Street Lynn, MA 01902 Dear Lieutenant Avery: I have received the petition of Marcus Kuhs, Esq., of Committee for Public Counsel Services, appealing the response of the Lynn Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 5, 2024, Attorney Kuhs filed a public records request for, “[a]ny reports, memo or FIOs written by [an identified officer] from January 1, 2022 to September 30, 2023.” The Department responded on May 14, 2024, and provided 52 redacted incident reports. Additionally, the Department asserted Exemption (f) of the Public Records Law to withhold 15 reports in their entirety. Unsatisfied with this response, Attorney Kuhs petitioned this office and this appeal, SPR24/1822, was opened as a result. Subsequently, I learned that the Department intends on providing a further response to Attorney Kuhs. Accordingly, the Department is ordered to provide Attorney Kuhs with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Kuhs may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
