General Counsel Cannabis Control Commission 2 Washington Square Worcester, MA 01604 Dear Attorney Bergquist: I have received the petition of Jillian Holland appealing the nonresponse of the Cannabis Control Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 7, 2024, Ms. Holland requested the following: [1.] Any and all documents which change the corporate officers of Apothca, Inc. from [an identified individual] to [an identified individual], including but without limitation to any filings of any name and/or nature with the Cannabis Control Commission. [2.] Any and all e mail correspondence and/or communication to and/or from Apothca, Inc. (including its agents, servants, employees and/or legal counsel) in 2022, 2023, and 2024. [3.] Copies of any licenses provided, awarded and/or issued to Apothca in 2022, 2023 and 2024. [4.] Copies of all licenses issued to Apothca, Inc. up to and including 2022. Claiming to not yet have received responsive records, Ms. Holland petitioned this office and this appeal, SPR24/1848, was opened as a result. Subsequently, I learned that the Commission intends on providing a response to Ms. Holland. Accordingly, the Commission is ordered to provide Ms. Holland with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Holland may appeal the substantive nature of the Commission’s response within ninety days. See 950 C.M.R. 32.08(1).
