Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite #3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of John York appealing the nonresponse of the Massachusetts Department of Transportation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 11, 2024, Mr. York requested the following records: [1] A copy of MassDOT Contract 57238 - Design - Services, “providing statewide photogrammetric services on an as needed assignment basis”, which is identified on the MassDOT Project 608020 Information page[;] [2] A copy of MassDOT Contract 57787 - Design - Highway Engineering Open End, “providing statewide engineering design and review services to MassHighway on an open end basis”, which is identified on the MassDOT Project 608020 Information page[;] [3] A copy of MassDOT Contract 64308 - Design - Highway Engineering Open End, “providing statewide engineering design and review services to MassDOT on a task order basis”, which is identified on the MassDOT Project 608020 Information page[;] [4] A copy of MassDOT Contract 77859 - Design - Highway Engineering Open End, “Master Services Agreement for statewide design and review services”, which is identified on the MassDOT Project 608020 Information page[;] [5] A copy of MassDOT Contract 77864 - Design - Highway Engineering Open End, “Master Services Agreement for statewide design and review services”, One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

SPR24/1994 Page 2 July 25, 2024 which is identified on the MassDOT Project 608020 Information page[;] [6] A copy of MassDOT Contract 77866 - Design - Highway Engineering Open End, “Master Services Agreement for statewide design and review services”, which is identified on the MassDOT Project 608020 Information page[;] [7] A copy of MassDOT Contract 77878 - Design - Highway Engineering Open End, “Master Services Agreement for statewide design and review services”, which is identified on the MassDOT Project 608020 Information page. Claiming to not yet have received responsive records, Mr. York petitioned this office and this appeal, SPR24/1994, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. York with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
