The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 17, 2024 SPR24/1996 Kate Silvia Director of Communications Record Access Officer Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Elise Lambert, of the Committee for Public Counsel Services, appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 17, 2024, Ms. Lambert requested the following: [1.] All policies and procedures of the Community Access Board (CAB), including but not limited to information and records regarding: Decision making during Annual Reviews on individuals’ current sexual dangerousness; [n]otifications to individuals about decisions on their current sexual dangerousness. [2.] All policies and procedures relating to DOC decision to file a petition pursuant to G. L. c. 123A, § 9. Claiming to not yet have received responsive records, Ms. Lambert petitioned this office and this appeal, SPR24/1996, was opened as a result. Subsequently, I learned that the Department provided Ms. Lambert with a response on June 20, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Lambert may appeal the substantive nature of the Department’s June 20th response within ninety (90) days. See 950 C.M.R. 32.08(1).
