The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 29, 2024 SPR24/2002 Christopher Burns Police Chief Palmer Police Department 4419 Main Street Palmer, MA 01069 Dear Chief Burns: I have received the petition of the Investigative Media Alliance (“requestor”) appealing the nonresponse of the Palmer Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 25, 2024, the requestor sought the following: [1.] All calls for service/incident logs related to Monson Developmental Center 07-01-2023 to present that identify the nature of the call for service, the date of call/incident and disposition of call/incident[;] [2.] All budget requests and/or appropriation(s), whether primary or supplemental, regarding services rendered to Monson Development Center, whether actual or anticipated for fiscal year 2023 and 2024. Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR24/2002, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide the requestor with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. The Requestor may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
