The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 25, 2024 SPR24/2062 Kate Silva Director of Communications Record Access Officer Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silva: I have received the petition of Darius Gibson appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 24, 2024, Mr. Gibson requested the following: [1.] Documentation as to the number of emails between [2 identified individuals] that have mentioned [a named individual’s] litigation[;] [2.] Documentation as to the date these emails referenced above began[;] [3.] Documentation as to who initiated the emails between [2 identified individuals] mentioning [a named individual’s] litigation[;] [4.] Documentation as to who initiated the emails between [2 identified individuals] have exchanged emails regarding any litigation[;] [5.] As of June 2024 names of all offices at SBCC and ranks. Claiming to not yet have received responsive records, Mr. Gibson petitioned this office and this appeal, SPR24/2062, was opened as a result. Subsequently, I learned that the Department provided Mr. Gibson with a response on July 15, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Gibson may appeal the substantive nature of the Department’s July 15th response within ninety (90) days. See 950 C.M.R. 32.08(1).
