Box 417 Stockbridge, MA 01262 Dear Ms. Underwood-Miller: I have received the petition of Michelle Loubert appealing the response of the Town of Stockbridge Conservation Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 9, 2024, Ms. Loubert requested “a copy of the Enforcement Order pertaining to the Housatonic Railroad as well as the Request for Determination for the Housatonic Railroad” and “copies of the minutes . . . of the Conservation Commission of the following meetings: July 11, 2023, July 25, 2023, August 22, 2023, and September 12, 2023.” The Commission responded on July 9, 2024. Unsatisfied with the Commission’s response, Ms. Loubert petitioned this office and this appeal, SPR24/2102, was opened as a result. Subsequent to the opening of this appeal, I learned that the Commission provided a supplemental response by email to Ms. Loubert and this office on July 25, 2024. As this appeal was opened based on the Commission’s July 9, 2024 response, I will now consider this administrative appeal closed. If unresolved issues remain, Ms. Loubert may further appeal the substantive nature of the Commission’s July 25, 2024 response within ninety (90) days. See 950 C.M.R. 32.08(1).
