See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 18, 2024, Mr. Binns requested the following: 1. Copies of the Department Manual, effective as of December 2022 and as it is currently 2. Any and all policies and procedures related to evidence collection, evidence preservation, evidence retention, and/or evidence storage, effective as of December 2022[.] Claiming to not yet have received responsive records, Mr. Binns petitioned this office and this appeal, SPR24/2148, was opened as a result. Subsequently, I learned that the Department provided Mr. Binns with a response dated July 30, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. It is my understanding that Mr. Binns has appealed the Department’s July 30, 2024 response resulting in a new appeal, which is currently opened as SPR24/2199.
