The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 13, 2024 SPR24/2158 Kelly Cote Town Clerk Town of Uxbridge 21 South Main Street Uxbridge, MA 01569 Dear Ms. Cote: I have received the petition of John Wise appealing the nonresponse of the Town of Uxbridge (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 2, 2024, Mr. Wise requested: [1] [E]mails, texts in writing communications from select board members and attorneys that reference . . . and/or video from June 1, 2024 through July 3, 2024… [2] Emails, texts, in writing-communications from the town manager . . . and attorneys that reference . . . and/or video from June 1, 2024 through July 3, 2024… [3] Any texts, emails, in writing communications sent or received by [identified individuals] and/or Town Manger referencing . . . and/or video between June 4, 2024 through July 3, 2024. [4] Written requests to communicate with town counsel be select board members to Town Manager . . . between June 1, 2024 and July 3, 2024.” Claiming to not yet have received responsive records, Mr. Wise petitioned this office and this appeal, SPR24/2158, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Mr. Wise with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Wise may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
