Rielly Regional Records Response Coordinator Department of Environmental Protection 8 New Bond Street Worcester, MA 01606 Dear Ms. Rielly: I have received the petition of Kathy Sferra appealing the response of the Department of Environmental Protection (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 28, 2024, Ms. Sferra requested, “a copy of all email correspondence to and from [an identified individual] and/or [an identified individual] at the Department with regard to a potential wetland violation on the Assabet River Rail Trail also known as Track Road/Crow Island in Stow. The emails are in the May-June 2024 timeframe.” The Department provided a response on July 2, 2024. Unsatisfied with the Department’s response, Ms. Sferra petitioned this office and this appeal, SPR24/2163, was opened as a result. Subsequently, the Department provided a supplemental response on August 2, 2024. Where this appeal was opened as a result of the Department’s July 2nd response, I will now consider this administrative appeal closed. Ms. Sferra may appeal the substantive nature of the Department’s August 2nd response within ninety days. See 950 C.M.R. 32.08(1).
