The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 13, 2024 SPR24/2170 Michael Bussell Fire Chief Town of Ashby Fire Department 1093 Main Street Ashby, MA 01431 Dear Chief Bussell: I have received the petition of Patrick McPhee appealing the response of the Town of Ashby Fire Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 2, 2024, Mr. McPhee requested, “…a report exactly the same for the fiscal year July 1, 2023 and ends June 30, 2024.” On June 18, 2024, the Department provided Mr. McPhee with a response, stating, “…[w]e are unable to complete your record request until June 30, 2024. At that time, we will complete this request.” Unsatisfied with the Department’s response, Mr. McPhee petitioned this office and this appeal, SPR24/2170, was opened as a result. Subsequently, I learned that the Department provided Mr. McPhee with a response on August 9, 2024, including the responsive record. Where this appeal this appeal was opened as a result of the Department’s June 18th response, I will now consider this administrative appeal closed. Mr. McPhee may appeal the substantive nature of the Department’s August 9th response within ninety (90) days. See 950 C.M.R. 32.08(1).
