The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 14, 2024 SPR24/2178 Allison Mondello Records Access Officer Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petition of Brian Barnes appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 15, 2024, Mr. Barnes requested the following: [1.] [A]ny Mass State Police manual, directive, or policy/procedure concerning the arrest and transport of disabled persons and their assistive devices. [2.] [A]ny Mass. State Police manual, directive or policy/procedure concerning summoning medical assistance when a person in their custody advises them they have fallen. [3.] [A]ny policy/procedure and training records concerning any classes either taught in the academy or during in-service training or special training or on-line training dealing with the arrest or encounter with disabled persons or any such training that teaches officers about compliance with the American with Disabilities Act. [4.] [A]ny and all policies dealing with the American with Disabilities Act from State Police policy & procedures dealing with American with Disabilities act. Claiming to not yet have received responsive records, Mr. Barnes petitioned this office and this appeal, SPR24/2178, was opened as a result. Subsequently, I learned that the Department provided Mr. Barnes with a response on August 14, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
