The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 20, 2024 SPR24/2229 Helene Bettencourt Associate Commissioner Commissioner’s Office Department of Elementary and Secondary Education 135 Santilli Highway Everett, MA 02149 Dear Ms. Bettencourt: I have received the petition of Marion King appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 9, 2024, Ms. King requested the following: On March 24, 2024, I submitted the following: . . . Please provide me with redacted copies of letters of finding and letters of closure for the following PRS complaints #: 2822 (Pembroke); 3977 (Plymouth); 3978 (Foxborough); 4054 (Maynard); 5918 (Tewksbury); 7475 (Concord); AND any other PRS complaints that address transportation for extended school year beginning 9/1/2021 through the date of this request. Please include any documents that would subsequently revise the letter of finding or letter of closure for any of the complaints. I received a partial response to the query above and have received no response to my further inquiries. Please accept this as a NEW request and therefore use today’s date as [‘]through the date of this request.[’] Kindly do not send me the records which were included in your previous and incomplete reply to [Ms. King’s March 24, 2024 request to the Department]. A representative of the Department responded on August 7, 2024, stating that Ms. King’s request “is currently being worked on and close to production.” Unsatisfied with the response, Ms. King petitioned this office and this appeal, SPR24/2229, was opened as a result. Subsequent to the opening of this appeal, the Department provided Ms. King with another response on August 7, 2024, which included responsive records. Accordingly, I will now consider this administrative appeal closed. Ms. King may appeal the substantive nature of the Department’s August 7th response within ninety days. See 950 C.M.R. 32.08(1).
