See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 29, 2024, Mr. O’Reilly requested, “any police reports or records and/or bodycam video generated during the evening of 7/21/24 related to the arrest of [a named individual].” The Department responded on August 6, 2024. Unsatisfied with the response, Mr. O’Reilly petitioned this office and this appeal, SPR24/2240, was opened as a result. Subsequently, I learned that a representative from the Department intends on providing a further response to Mr. O’Reilly to address his records request. Accordingly, the Department is ordered to provide Mr. O’Reilly with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. O’Reilly may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
