The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 26, 2024 SPR24/2281 Denise Quist Town Clerk Town of Winthrop Town Hall One Metcalf Square Winthrop, MA 02152 Dear Ms. Quist: I have received the petition of Carole Mietzsch appealing the response of the Town of Winthrop (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 3, 2024, Ms. Mietzsch requested the following: All emails, text messages or any other electronic or written communication by and/or between members of the Winthrop Town Council for all matters regarding MBTA 3A or Winthrop zoning matters from their private email, or electronic accounts. As well as all electronic by and/or between the Winthrop Town Council members through their private email or cellular telephone accounts on all matters regarding MBTA 3A or Winthrop zoning matters. Please also provide all emails, text messages or any other electronic or written communication including private email or electronic accounts including cellular telephone accounts by and/or between the EOHLC, Senator ... and the Winthrop Town Council members on all matters regarding MBTA 3A or Winthrop zoning matters. The Town responded on August 5, 2024, providing numerous responsive records. Unsatisfied with the Town’s response, Ms. Mietzsch petitioned this office, and this appeal, SPR24/2281, was opened as a result. Subsequent to the opening of this appeal, based on an email from the Town to Ms. Mietzsch and this office on August 14, 2024, I understand that the Town intends to provide a supplemental response to Ms. Mietzsch. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten business days.
