Iversen Office of the Mayor City of Framingham 150 Concord Street Framingham, MA 01702 Dear Mr. Iversen: I have received the petition of Geoffry Rogers appealing the nonresponse of the City of Framingham (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 24, 2024, Mr. Rogers requested: [1] [A] digital copy of the recorded phone call made to Framingham PD at approximately 6:50 PM on July 22, 2024 by [an identified individual] of [a specified address] [2] [A] digital copy of any body-worn police camera video recordings from the responding officers who spoke with [an identified individual] at [a specified address] at approximately 6:55-7:02 PM on July 22, 2024 [3] [A] digital copy of the police report made by the officers after speaking with [an identified individual] on the dates and times mentioned above[.] Claiming to not yet have received responsive records, Mr. Rogers petitioned this office and this appeal, SPR24/2286, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the City has provided a response. Accordingly, the City is ordered to provide Mr. Rogers with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Rogers may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
