See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 10, 2024, Mr. McDonagh requested the following: [1.] The Public Profile for [an identified individual] who is emplyed [sic] by Wellpath, LLC[;] [2.] A Copy of this request with the date received by your office stamped on it. Claiming to not yet have received responsive records, Mr. McDonagh petitioned this office and this appeal, SPR24/2308, was opened as a result. Subsequently, I learned that the Board provided Mr. McDonagh with a response on August 12, 2024. Where this appeal was opened as a result of the Board’s lack of a written response, I will now consider this administrative appeal closed. Mr. McDonagh may appeal the substantive nature of the Board’s August 12th response within ninety (90) days. See 950 C.M.R. 32.08(1).
