The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 29, 2024 SPR24/2328 Melanie Waddell Town Clerk Rockport Town Hall 34 Broadway Avenue Rockport, MA 01966 Dear Ms. Waddell: I have received the petition of John Kolackovsky appealing the response of the Town of Rockport (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 29, 2024, Mr. Kolackovsky requested, “. . . the contractors that bid on the DPW Building, their bids and the winning contractor. In addition, were there any other planned expenditures or related expenditure that have been paid or will be paid? If so, the bids and the companies that bid and the winning company(s).” The Town provided a response on August 12, 2024. Unsatisfied with the Town’s response, Mr. Kolackovsky petitioned this office and this appeal, SPR24/2328, was opened as a result. Based upon a telephone conversation between a Public Records Division staff member and a Town representative on August 29, 2024, it is my understanding that the Town intends on providing a subsequent response to Mr. Kolackovsky. Accordingly, the Town is ordered to provide Mr. Kolackovsky with said response to his request in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Kolackovsky may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
