Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Charles E. Dow, Esq. appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 23, 2024, Attorney Dow requested: All documents, plans and specifications for the proposed reconstruction of the Red Line northbound and southbound between the Charles Street/MGH Station to the portal of the Beacon Hill Tunnel (Station 509+50 to Station 509+00) including but not limited to all proposed structural elements and all items proposed for the mitigation of sound and vibration such as sound wall, sound roof, ballast mats, track fasteners, etc. Previous Appeal The request was the subject of a previous appeal. See SPR24/2089 Determination of the Supervisor of Records (August 6, 2024). In my August 6th determination, it was my understanding that the MBTA intends on providing a further response to Attorney Dow. The MBTA responded on August 7, 2024. Unsatisfied with the response, Attorney Dow petitioned this office and this appeal, SPR24/2358, was opened as a result. It is my understanding that the MBTA intends on providing a further response to Attorney Dow to address the records request. Accordingly, the MBTA is ordered to provide Attorney Dow with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office.
