The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 30, 2024 SPR24/2360 Diane Pelland Town Clerk Town of Swansea 81 Main Street Swansea, MA 02777 Dear Ms. Pelland: I have received the petition of Geraldine Mullaly appealing the nonresponse of the Town of Swansea to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 4, 2024, Ms. Mullaly requested the following: [1.] Committee Meeting Minutes at which programming, designing, etc. the Town Hall Annex into a repaired, renovated, and/or expanded Town Hall was discussed by CHA consulting, T2 Architects, and/or the Building Committee[;] [2.] Invoice/estimate/quote for an asbestos abatement referred to in the Capital Building Committee Meeting Minutes of 06-25-2024[;] [3.] The hazardous material study completed/used to request a quote for the aforementioned abatement (also noted in Capital Building Committee Meeting Minutes of 06-25-2024. Claiming to not yet have received responsive records, Ms. Mullaly petitioned this office and this appeal, SPR24/2062, was opened as a result. Subsequently, I learned that the Town provided Ms. Mullaly with a response on August 19, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Ms. Mullaly may appeal the substantive nature of the Town’s August 19th response within ninety (90) days. See 950 C.M.R. 32.08(1).
