Assistant City Solicitor City of Worcester Law Department 51 Sever Street Worcester, MA 01609 Dear Attorney Thompson: I have received the petition of Tom Marino, of This Week In Worcester, appealing the nonresponse of the City of Worcester (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 27, 2024, Mr. Marino requested “any Worcester Police Department policy or other document which defines criteria and/or procedures for referrals or notifying the Massachusetts Department of Children and Families of matters relevant to its responsibilities. Also, please provide statistics related to the number of referrals or notifications by the Worcester Police Department to the Massachusetts Department of Children and Families between 2000 and 2003, or the latest three years for which data is available” Claiming to not yet have received responsive records, Mr. Marino petitioned this office and this appeal, SPR24/2361, was opened as a result. It is my understanding that a representative from the City intends on providing a written response to Mr. Marino. Accordingly, the City is ordered to provide Mr. Marino with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Marino may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
