See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 15, 2024, Mr. Imbert requested the following: [1] All work product, to include but not limited to notes, of [an identified employee], and any Suffolk County District Attorney’s Office employee who worked or had any involvement in [an identified court case], to include but not limited to both fact and opinion work product. [2] All police reports filed from April 2, 2004 to the present day that reference in any way events that occurred on April 3, 2004 at or near an established called “The Lions Den” in Revere, Massachusetts. [3] All statements in possession, custody, or control of the Suffolk County District Attorney’s Office, wherever catalogued or recorded or archived, including but not limited to law enforcement, prosecutor and advocates’ notes that may be related to the matter of [an identified court case]. [4] All notes of prosecutors and investigators relating to conversations with witnesses in the matter, or related to, [an identified court case]. [5] All documents that reference the nickname or the related name of [an identified individual]. [6] All drafts and final reports of both the Suffolk County District Attorney’s Office and the Mass State Police in the matter of the death of [an identified individual]. [7] All emails or other electronic communications between prosecutors or other employees of the Suffolk County District Attorney’s Office and law enforcement (Detectives, Troopers, etc.) related in any way to the matter of [an identified court case]. [9] All memos to and from prosecutors and their supervisors of or related to the matter of [an identified court case], and any document that references the following individuals related to any case not currently under investigation by the Suffolk County District Attorney’s Office:[identified individuals]. Claiming to not yet have received responsive records, Mr. Imbert petitioned this office and this appeal, SPR24/2368, was opened as a result. Subsequently, I learned that the Office provided Mr. Imbert with a response dated August 27, 2024. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed.
