Assistant City Solicitor City of Worcester Legal Department 455 Main Street Worcester, MA 01609 Dear Attorney Thompson: I have received the petition of David Webb appealing the nonresponse of the Worcester Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 7, 2024, Mr. Webb requested “a copy of arrests for trespassing that list [an identified address] Worcester, MA 01609 as the address between the dates of January 1st and June 31st 2024.” Claiming to not yet have received responsive records, Mr. Webb petitioned this office and this appeal, SPR24/2380, was opened as a result. Subsequently, I learned that the Department provided Mr. Webb with a response dated August 21, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Webb may appeal the substantive nature of the Department’s August 21st response within ninety (90) days. See 950 C.M.R. 32.08(1).
