Office of General Counsel Massachusetts Department of Environmental Protection 1 Winter Street Boston, MA 02108 Dear Attorney Delaplain: I have received the petition of Meg Miller Ruley appealing the response of the Massachusetts Department of Environmental Protection (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 4, 2024, Ms. Ruley requested, “all of the private well data for PFAS that UMASS has collected on Nantucket - between 2019 and present.” Additionally, on June 6, Ms. Ruley requested “the address associated with the well number for the Town of Nantucket.” The Department provided a response on August 22, 2024, redacting responsive records. Unsatisfied with the response, Ms. Ruley petitioned this office and this appeal, SPR24/2429, was opened as a result. Subsequently, I learned that the Department provided a further response on September 4, 2024. Where this appeal was opened as a result of the Department’s August 22, 2024 response, I will now consider this administrative appeal closed. Ms. Ruley may appeal the substantive nature of the Department’s September 4th response within ninety (90) days. See 950 C.M.R. 32.08(1).
