Box 1475 Cotuit, MA, 02635 Dear Mr. Eager: I have received the petition of Attorney Anthony Panebianco appealing the nonresponse of the Cotuit Fire District (District) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 12, 2024, Attorney Panebianco requested the following: [1] Any and all communications of any kind, either written, verbal, direct or indirect, by or between any member(s) of the Prudential Committee, Planning Board, Zoning Board or Town management regarding the Cotuit Community Center or the Property, from the time period between [August 12, 2024] and January 1, 2020. [2] Any and all communications of any kind, either written, verbal, direct or indirect, by or between any Town Officials or [identified individuals] and any third party regarding the Cotuit Community Center or the Property, from the time period between [August 12, 2024] and January 1, 2020. Claiming to not yet have received responsive records, Attorney Panebianco petitioned this office and this appeal, SPR24/2433, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the District has provided a response. Accordingly, the District is ordered to provide Attorney Panebianco with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Panebianco may appeal the substantive nature of the District’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
