The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 10, 2024 SPR24/2449 David Stairs Town Clerk Town of Pepperell 1 Main Street Pepperell, MA 01463 Dear Mr. Stairs: I have received the petition of Patrick McPhee appealing the nonresponse of the Town of Pepperell (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 2, 2024, Mr. McPhee requested “a report exactly the same for the fiscal year July 1, 2023 and ends June 30, 2024.” Claiming to not yet have received responsive records, Mr. McPhee petitioned this office and this appeal, SPR24/2449, was opened as a result. Subsequently, I learned that the Town provided Mr. McPhee with a response on September 10, 2024. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. McPhee may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
