Assistant General Counsel Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Robert Sullivan appealing the nonresponse of the Department of Transportation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 14, 2024, Mr. Sullivan requested “the most up to date list of vendors working for the DOT Snow & Ice…their mailing address and their email addresses… [and] hired equipment levels for the last 5 years, 2018-2023 per district and per pit, i.e. reporting locations.” Claiming to not yet have received responsive records, Mr. Sullivan petitioned this office and this appeal, SPR24/2464, was opened as a result. Subsequently, I learned that the Department provided Mr. Sullivan with a response dated August 29, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Sullivan may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
