The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 16, 2024 SPR24/2467 Adam Lamontagne Town Administrator Town of Templeton Town Hall, Room 6 160 Patriots Road East Templeton, MA 01438 Dear Mr. Lamontagne: I have received the petition of Robert May appealing the response of the Town of Templeton (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 19, 2024, Mr. May requested the following: [1.] ... electronic copies of all communications between the Town of Templeton and MacVallee LLC/ Clean Vision Corp to include communication regarding this item from the Flick Law Group P.C. [2.] ... a present status and amount of the taxes owed on the property known as [a specified address on] Holman St. On August 20, 2024, Mr. May provided the following clarification regarding Item 1 of the request: [A]ny and all of the communication between the aforementioned groups and the Town Administrator. ... This should include all communication whether received by [the Town Administrator] or by the Town of Templeton that was in any part responded to [the Town Administrator] or the Town legal counsel under the direction of [the Town Administrator]. The Town responded on August 20, 2024, providing information responsive to Item 2 of the request, and seeking clarification regarding Item 1. Unsatisfied with the Town’s response to Item 1, Mr. May petitioned this office, and this appeal, SPR24/2467, was opened as a result. Specifically, a representative for the Town explained the following: I’ve tried to send the documents to the complainant’s email twice, we have the hard copies in the office available for pickup. Both emails rejected the attached documents. ... I will work to try to break the document into smaller versions that his email can handle. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. This office encourages Mr. May and the Town to communicate directly in order to facilitate providing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii). If issues remain unresolved, Mr. May may appeal the substantive nature of the Town’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
