The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 11, 2024 SPR24/2481 Carter Terenzini Interim Town Manager Town of Lunenburg 17 Main Street Lunenburg, MA 01462 Dear Mr. Terenzini: I have received the petition of John P. Bowen appealing the response of the Town of Lunenburg (Town) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On August 9, 2024, Mr. Bowen requested, “[e]mails within the last 30 days of communications between [an identified former Town manager] and [an identified] Cemetery Commissioner . . . wherein the town manager requested the Commission Chair . . . to address the specifics of the West Street Terrace Burial ground. . . .” The Town responded on August 15, 2024, providing a fee estimate, and on August 16, 2024. Unsatisfied with the Town’s responses, Mr. Bowen petitioned this office and this appeal, SPR24/2481, was opened as a result. Subsequent to the opening of this appeal, based on an email to Mr. Bowen and this office on September 11, 2024, I understand that the Town intends to provide a supplemental response to Mr. Bowen. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Bowen may appeal the substantive nature of the Town’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
