The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 16, 2024 SPR24/2482; SPR24/2483; SPR24/2484 Sergeant Matthew Fallon Leominster Police Department 116 Central Street Leominster, MA 01453 Dear Sergeant Fallon: I have received the petitions of Kent DeMott appealing the nonresponse of the Leominster Police Department (Department) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In three (3) separate requests on July 9, 2024 and July 10, 2024, Mr. DeMott requested the following records: [1] All body worn camera evidence and written police reports for the police visit to [a specified address] for subject [identified individuals], that occurred on July 9, 2024[;] [2] All body worn camera evidence and written police reports for the police visit to [a specified address], and/or with any interactions with for subject [identified individuals], that occurred on July 10, 2024[;] [3] All body worn camera evidence and written police reports for all interactions with [an identified individual] that occurred on July 10, 2024, for at least the following locations:...[.] Claiming to not yet have received responsive records, Mr. DeMott petitioned this office and the following appeals: SPR24/2482, SPR24/2483, and SPR24/2484, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. DeMott with a response to the requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. DeMott may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
