The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 13, 2024 SPR24/2490 Allison Mondello Public Records Manager Department of State Police 470 Worcester Street Framingham, MA 01702 Dear Ms. Mondello: I have received the petition of Attorney Joseph Hennessey appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 29, 2024, Attorney Hennessey requested the following: [1] Motor vehicle violation citations and warnings both civil and criminal issued by [an identified individual] between January 1, 2020 to December 31, 2023… [containing] all fields found in the Massachusetts Uniform Citation that may be disclosed without personally identifying violators… provided in a searchable excel file. [2] All State Police citations from 3/12/21 to 9/12/22 for the following locations: Auburn, Brimfield, Charlton, Dudley, Framingham, Millbury, Northborough, Oxford, Palmer, Paxton, Southbridge, Sturbridge, Warren, Webster, Westborough, [and] Worcester. Seeking all records as to race, violation, arrest, civil infractions, searches, and all data relating to motor vehicle stops for this area. Claiming to not yet have received responsive records, Attorney Hennessey petitioned this office and this appeal, SPR24/2490, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Hennessey with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Hennessey may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
