Director of Public Records City of Boston One City Hall Square Boston, MA 02201 Dear Attorney Williams: I have received the petition of Blue POV (requestor) appealing the response of the Boston Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 4, 2024, the requestor sought “… all bodycam footage for the arrest of [a named individual] … [i]ncident number 222042280.” On September 4, 2024, the Department provided the requestor with a video recording redacted under Exemption (c). Unsatisfied with the Department’s response, the requestor petitioned this office and this appeal, SPR24/2497, was opened as a result. In an email dated September 11, 2024, the Department provided a more detailed justification for the redactions made to the responsive record. Subsequently, in a September 16, 2024 telephone conversation between the Department and a staff member of the Public Records Division, the Department expressed its intent to provide the requestor with a supplemental response. Accordingly, the Department is ordered to provide the requestor with said response in a manner consistent with the Public Records Law, its Regulations and this order within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. The requestor may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
