The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 19, 2024 SPR24/2536 John Pyers Lowell Police Department 50 Arcand Drive Lowell, MA 01852 Dear Mr. Pyers: I have received the petition of Colman Herman appealing the nonresponse of the Lowell Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 23, 2024, Mr. Herman stated: 1) In May I sent you the questions below regarding the ‘Physical Fitness Incentives’ program’ that is contained in the collective bargaining agreement that the City of Lowell has executed with its police officers. a) When did the ‘Physical Fitness Incentives program’ begin? b) How many police officers have participated in the program since its inception? c) What is the total dollar amount awarded to the police officers who have participated in the program since its inception . . . 3) Since I have not heard back, please provide me with copies of any and all records that contain the information I am seeking in item #1 above. Claiming to not yet have received responsive records, Mr. Herman petitioned this office and this appeal, SPR24/2536, was opened as a result. Subsequently, I learned that the Department provided Mr. Herman with a response dated September 13, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
